Rescission

A legal remedy that unwinds a contract as if it never existed — the parties are returned to their pre-contract positions. The remedy sought when an Ontario HVAC agreement is set aside under the 2018 CPA amendments.

Where an Ontario HVAC contract is rescinded on CPA grounds, the homeowner keeps the installed equipment, any registration on title is discharged, and (where appropriate) damages and costs may be recovered.

Rescission is distinct from cancellation during the cooling-off period, though both have similar practical effects.
