Misrepresentation

A false or misleading statement that induces a consumer to enter into an agreement. Misrepresentations about energy savings, government affiliation, or rebates are recognised grounds under the 2018 CPA amendments.

Material misrepresentations made at the original sale travel with the contract when it is assigned to a finance company. They support both rescission and damages claims.

Common Ontario HVAC misrepresentations: 'we're part of a government rebate programme,' 'this will pay for itself in energy savings,' 'we'll service it free for the life of the contract.'
